Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Yup mobile application, website, and related services (the "Service") operated by Danylo Hennadiiovych Dubrovskyi, a sole proprietor registered in Ukraine ("Yup", "we", "us", or "our"). By creating an account, using Yup, or allowing a child to use Yup, you agree to these Terms. If you do not agree, do not use the Service.
1. What Yup Does
Yup helps families create tasks, missions, routines, coins, rewards, and parent-managed store items. The Service is intended to support motivation, routine-building, and family organization and is directed primarily to parents and guardians. Yup does not replace parental judgment, childcare, education, medical advice, mental health care, safety supervision, or emergency services.
2. Parent and Child Use
A parent or legal guardian must create and manage the main family account. If you are a parent or legal guardian, you are responsible for:
Deciding whether Yup is appropriate for your family.
Creating and managing child profiles.
Giving any required consent for your child to use the Service.
Supervising your child's use of the Service.
Choosing tasks, missions, rewards, and routines that are safe and age-appropriate.
Keeping account login information secure.
Children may use child-facing parts of Yup only with permission from their parent or legal guardian.
3. Eligibility
You must be at least 18 years old, or the age of legal majority in your location, to create a parent account. If you are under 18, you may use Yup only as part of a family account managed by your parent or legal guardian. For children under 13 in the United States, and children below the applicable digital consent age in the EEA or UK, Yup requires parent or guardian consent where required by law.
4. Accounts
You agree to provide accurate account information and keep it updated. You are responsible for all activity under your account, including activity by child profiles connected to your family account. You must notify us promptly at support@yup.kids if you believe your account has been compromised.
5. Family Content
"Family Content" means tasks, missions, routines, child profile details, reward descriptions, notes, comments, images, avatars, or other content that you or your family add to Yup. You keep ownership of your Family Content. You give Yup a limited license to host, store, process, display, and use Family Content only as needed to provide, secure, support, and improve the Service. You represent that you have the rights and permissions needed to upload or enter Family Content into Yup.
6. Rewards, Coins, and Parent-Managed Store
Yup may include coins, points, streaks, badges, rewards, or similar motivational features. These features are for family motivation only. Unless we clearly say otherwise:
Yup coins, points, streaks, and badges have no cash value.
They cannot be exchanged with Yup for money, goods, or services.
Parent-created rewards are promises between the parent or guardian and child.
Parents are responsible for deciding whether rewards are appropriate, safe, affordable, and lawful.
Yup is not responsible for fulfilling parent-created rewards.
7. Acceptable Use
You must not:
Use the Service for unlawful, harmful, abusive, deceptive, or unsafe purposes.
Add content that is illegal, hateful, harassing, sexually explicit, exploitative, or harmful to children.
Upload private information about another person without permission.
Attempt to access another family account.
Interfere with the Service, reverse engineer it, scrape it, or bypass security.
Use Yup to monitor, pressure, shame, or harm a child.
Use the Service in a way that violates child safety, privacy, or consumer protection laws.
We may remove content or suspend accounts that violate these Terms or create risk for users, children, Yup, or others.
8. Child Safety
Yup is a family organization tool. It does not verify that tasks are safe, that rewards are fulfilled, or that family routines are appropriate for a specific child. Parents and guardians are solely responsible for:
Real-world supervision.
Safety of chores, missions, and activities.
Age-appropriate expectations.
Any physical, emotional, financial, or educational consequences of family decisions made outside the app.

9. Subscriptions and Purchases
Yup may offer free and paid features. Paid subscriptions or purchases may be processed through Apple App Store, Google Play, Stripe, or another provider. Prices, taxes, renewal terms, cancellation options, refunds, and billing rules may be shown at the point of purchase and may also be governed by the relevant app store or payment provider. Unless required by law or stated at purchase, payments are non-refundable. You can manage app store subscriptions through your Apple or Google account settings. Subscription provider details: Apple App Store and Google Play for mobile app purchases and subscriptions. If Yup later adds web billing or another payment channel, these Terms will be updated.
10. Waitlist and Pre-Launch Access
As of the "Last updated" date, Yup's website presents the mobile app as coming soon and allows visitors to join a waitlist. Joining the waitlist does not guarantee access to the app, a launch date, a specific feature, a free plan, or a paid plan. We may contact waitlist users about launch updates, early access, support, investor requests, partner requests, and related Yup news. You can ask us to remove your waitlist information by contacting support@yup.kids or privacy@yup.kids.
11. Trials and Promotions
We may offer trials, discounts, or promotions. We may change or end promotions at any time unless the promotion terms say otherwise. If a trial converts to a paid subscription, the renewal and cancellation terms shown at sign-up will apply.
12. Intellectual Property
Yup and its software, design, names, logos, features, and content are owned by Yup or its licensors and are protected by intellectual property laws. You may use the Service only for personal family use and only as allowed by these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service unless we give written permission.
13. Feedback
If you send us ideas, suggestions, or feedback, you allow us to use them without restriction or compensation. We appreciate feedback, but please do not send confidential information unless we have agreed in writing.
14. Privacy
Our Privacy Policy explains how we collect, use, share, and protect information. Our COPPA / GDPR-K Notice explains additional parent and child privacy practices for parent-managed child profiles and child-facing features. By using Yup, you agree that we may process information as described in those documents.
15. Third-Party Services
Yup may depend on third-party services such as app stores, payment providers, cloud hosting, analytics, crash reporting, authentication, support tools, and push notification providers. We are not responsible for third-party services, and their own terms and privacy policies may apply.
16. Service Changes
We may add, remove, change, suspend, or discontinue features. We will try to give reasonable notice for material changes that affect paid users, but we cannot guarantee that every feature will always be available.
17. Termination
You may stop using Yup at any time. You may request account deletion by contacting support@yup.kids or using in-app settings if available. We may suspend or terminate access if:
You violate these Terms.
Your use creates legal, security, privacy, or safety risk.
We must do so to comply with law.
The Service is discontinued.
After termination, some provisions of these Terms will continue, including intellectual property, disclaimers, liability limits, dispute terms, and any payment obligations already incurred.
18. Disclaimers
To the fullest extent allowed by law, the Service is provided "as is" and "as available." We do not guarantee that Yup will be uninterrupted, error-free, secure, or suitable for every family need. Yup does not guarantee child behavior changes, task completion, educational outcomes, family outcomes, or reward fulfillment. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.
19. Limitation of Liability
To the fullest extent allowed by law, Yup and its owners, employees, contractors, partners, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business. To the fullest extent allowed by law, Yup's total liability for any claim will be limited to the greater of:
The amount you paid to Yup for the Service in the 12 months before the claim; or
USD 100.
Nothing in these Terms limits liability that cannot be limited by law.
20. Indemnity
To the extent allowed by law, you agree to defend and hold harmless Yup from claims, damages, losses, liabilities, and expenses arising from your misuse of the Service, your Family Content, your violation of these Terms, or your violation of law. This section may not apply to consumers in some jurisdictions.
21. Governing Law and Disputes
These Terms are governed by the laws of Ukraine, excluding conflict of law rules. Courts / dispute forum: the courts of Odesa, Ukraine, unless mandatory consumer protection law in your place of residence requires another forum. You may also have mandatory consumer rights in your country or state of residence.
22. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice in the app, by email, or by another reasonable method. Continued use of Yup after changes become effective means you accept the updated Terms.
